1. Purpose and acceptance
These Terms of Service (hereinafter "ToS") govern access to and use of the Proxae service, available at proxae.com, provided by EVERLATS S.L. (hereinafter "Proxae" or "the Provider").
Use of the service constitutes full and unconditional acceptance of these ToS. If you disagree with any provision, you must refrain from using the service.
Proxae reserves the right to modify these ToS at any time. Significant changes will be notified at least 15 days in advance to users with an active account. Continued use of the service after notification constitutes acceptance of the new terms.
2. Description of the service
Proxae is a digital content existence certification service that allows users to prove that a text, idea, or file existed at a specific point in time. The technical operation is based on the following principles:
- β¦The SHA-256 fingerprint of the content is computed directly in the user's browser via the SubtleCrypto API. In standard mode, the original content is never transmitted to Proxae's servers. In Pro mode with content storage, content is encrypted in the browser (AES-256-GCM) before any transmission; Proxae stores only the ciphertext.
- β¦The cryptographic fingerprint is anchored in the Bitcoin blockchain via the open-source OpenTimestamps protocol, through public calendar servers.
- β¦Pro subscribers additionally receive a qualified timestamp compliant with RFC 3161, issued by Sectigo Limited, acting as a Qualified Trust Service Provider (QTSP) recognised under Regulation (EU) No 910/2014 (eIDAS). This timestamp complements the Bitcoin anchor with a certification of full evidentiary value in the European context. Proxae acts as a technical intermediary and is not itself a QTSP.
- β¦Once the anchor is confirmed, the proof is independently and permanently verifiable, even without Proxae.
- β¦In URL certification mode, Proxae accesses the webpage specified by the user, generates a full screenshot and archives the content in a cryptographically signed ZIP file. The only technical modification applied during capture is the blocking or hiding of cookie consent banners, via public open-source filter lists (Fanboy's Cookie Monster List, distributed under a Creative Commons licence). The certified SHA-256 hash is that of the complete ZIP file.
Proxae certifies the existence of content at a given moment β not its authorship, originality, or artistic or commercial value. Certification does not confer intellectual property rights.
3. Access and user accounts
Anonymous use
The service can be used without creating an account for basic certification. Anonymous proofs are identified by the IP address hash at the time of creation and cannot be claimed by another user once created.
Account creation
Account creation requires a valid email address. Authentication is performed via a one-time code (OTP) sent by email; no password is used. The user is responsible for the confidentiality of their account and all actions performed with it.
Age requirement
The service is intended for persons aged 18 or over, or for minors with the consent of their legal guardians to enter into online contracts.
4. Plans and pricing
Free plan
Enables content certification with the basic service features, at no cost and with no proof limit. Free plan conditions may be modified with prior notice.
Pro plan
Offers additional features via paid subscription, including: encrypted storage of original content, RFC 3161 qualified timestamp issued by Sectigo (eIDAS), download of the full certification bundle, webpage screenshots and advanced export. Payments are handled entirely by Stripe, Inc. Proxae does not store banking data.
Billing and refunds
The Pro subscription renews automatically until cancelled. Users may cancel at any time from their settings panel; Pro access is maintained until the end of the already paid period. In accordance with European consumer law, the 14-day right of withdrawal does not apply to digital services whose execution has begun with the user's express consent.
5. User obligations and responsibilities
The user agrees to:
- βUse the service only to certify content over which they hold legitimate rights or sufficient authorisation.
- βNot certify unlawful, defamatory content, content infringing third-party rights, third-party personal data without consent, or material protected by third-party intellectual property rights without authorisation.
- βNot make fraudulent or abusive use of the service, including automated mass generation of proofs.
- βKeep the certified original file. Proxae certifies the fingerprint; establishing the correspondence between that fingerprint and the original content is the user's sole responsibility.
- βProvide accurate information at registration and keep it up to date.
The user is solely responsible for the content they certify. Proxae does not examine or moderate certified content, as it only receives its irreversible cryptographic fingerprint.
6. Scope and evidentiary value of certifications
Proxae provides strong cryptographic evidence that a given SHA-256 fingerprint existed before a specific Bitcoin block. However, the legal value of this evidence depends on the applicable legal context and competent jurisdiction.
What Proxae certifies (free plan): that a specific SHA-256 fingerprint was presented to OpenTimestamps calendar servers before the inclusion of a given Bitcoin block, whose timestamp is independently verifiable on the blockchain.
What Proxae additionally certifies (Pro plan): the RFC 3161 qualified timestamp issued by Sectigo constitutes a "qualified electronic time stamp" within the meaning of Article 42 of the eIDAS Regulation, to which Article 41(2) attributes the legal presumption of accuracy of the date and time. This presumption is enforceable before the courts of all EU Member States.
What Proxae does not certify: the authorship of the content, its originality, its legal value in any specific proceeding, or the identity of the user (for anonymous proofs).
7. Permanence and immutability of proofs
The anchoring of a fingerprint in the Bitcoin blockchain is irreversible by nature. Once confirmed, no entity β including Proxae β can remove the anchor from the blockchain.
Deleting a user account entails deletion of the associated metadata stored on Proxae's servers, but not deletion of the Bitcoin anchor, which is permanent by design.
The user expressly accepts this technical characteristic by using the service.
8. Availability and service continuity
Proxae strives to provide the service continuously but does not guarantee 100% availability. The service may be temporarily interrupted for maintenance, updates, or force majeure events.
The Bitcoin anchoring process depends on OpenTimestamps public calendar servers and the Bitcoin network β decentralised infrastructures over which Proxae has no control. Typical confirmation times are 1 to 2 hours.
In the event of permanent service shutdown, Proxae will notify users with an active account at least 60 days in advance and will facilitate the export of their data and .ots certificates.
9. Limitation of liability
To the maximum extent permitted by applicable law, Proxae shall not be liable for:
- βLoss of the original file by the user.
- βRejection of the proof by a court or administrative body in any jurisdiction.
- βDamages arising from use of the service for unlawful purposes or in breach of these ToS.
- βService interruptions due to the Bitcoin network, OpenTimestamps servers, or force majeure events.
- βIndirect damages, loss of profit, or data loss not directly resulting from a culpable breach by Proxae.
Proxae's total liability towards the user shall not exceed the amount paid in the 12 months preceding the event giving rise to the damage, or β¬50 for free plan users.
10. Intellectual property
All elements of the Proxae service (software, interfaces, brand, logos, texts) are the exclusive property of EVERLATS S.L. and are protected by applicable intellectual and industrial property laws.
The user retains full rights over the content they certify. Use of the service transfers no intellectual property rights to Proxae.
11. Termination
The user may terminate their contract at any time by deleting their account from the settings panel. Account data will be deleted immediately; Bitcoin anchors are permanent and irreversible.
Proxae may immediately suspend or cancel an account in the event of fraudulent, abusive, or ToS-violating use.
12. Personal data protection
The processing of personal data is governed by Proxae's Privacy Policy, which forms an integral part of these ToS. The data controller is EVERLATS S.L., located at C/ TimΓ³n, 37, 30710 Los AlcΓ‘zares (Murcia), Spain.
13. Governing law and jurisdiction
These ToS are governed by Spanish law, in particular Law 34/2002 on Information Society Services, Regulation (EU) 2016/679 (GDPR) and Regulation (EU) No 910/2014 (eIDAS).
For dispute resolution, the parties submit to the courts of Los AlcΓ‘zares (Murcia, Spain), unless applicable consumer regulations provide for a different jurisdiction in favour of the user.
